DMCA Policy

1. Overview

IPWeb3, operated by Zinkvision, respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the IPWeb3 platform.

3. Filing a DMCA Takedown Notice

If you believe that content hosted on IPWeb3 infringes your copyright, you may submit a written notification to our DMCA Agent. Under 17 U.S.C. § 512(c)(3), your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
  3. Identification of the material that is claimed to be infringing, including information reasonably sufficient to permit us to locate the material (e.g., URLs, IP asset IDs, certificate IDs).
  4. Your contact information, including address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are authorized to act on behalf of the copyright owner.

4. Our Response

Upon receiving a valid DMCA takedown notice, we will:

  1. Remove or disable access to the allegedly infringing material within 10 business days.
  2. Notify the account holder whose content was removed.
  3. Provide the account holder with the option to file a counter-notification.

Important — On-chain Content: Content registered on-chain (on-chain records, IPFS files) is permanent and cannot be deleted or modified. In the event of a valid DMCA takedown, we will remove the content from the IPWeb3 platform interface (marketplace listings, certificates, portal access), but the underlying on-chain transaction and IPFS file will remain accessible on the public networks. We will clearly mark the registration as disputed.

5. Counter-Notification

If you believe your content was removed in error, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, any judicial district in which Zinkvision may be found), and that you will accept service of process from the person who provided the original DMCA notification.

Upon receiving a valid counter-notification, we will forward it to the original complainant and restore the material within 10-14 business days unless the complainant files a court action.

6. Repeat Infringer Policy

IPWeb3 maintains a strict repeat infringer policy in accordance with the DMCA:

  • First offense: Content removed, written warning issued to the account holder.
  • Second offense: Content removed, account placed on probation with restricted upload capabilities.
  • Third offense: Account terminated. All platform access revoked. On-chain assets must be transferred or forfeited per our Terms of Service.

Each strike remains on the account permanently. We reserve the right to terminate accounts at any time for egregious infringement, even on a first offense.

7. Good Faith

Please be aware that filing a false DMCA takedown notice may result in liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f). Before filing a notice, please consider whether the use of the material could be considered fair use.
